s503 CA 2016 - liquidators managed to get court order to examine 12 past and current officers of company in liquidation over a period of nearly 3 years since 2021.

Purchasers Group's claims dismissed

In late 2019, 6 purchasers filed an application for leave from court to sue a developer that went into liquidation. After leave was granted by the Court to the 6 purchasers in 2020, a suit was filed by 59 purchasers instead of 6, against the developer, the landowners, the land offices and authorities for damages based on alleged fraud. The liquidator and the land proprietors applied to strike out the suit. The Court in 2022 allowed the striking out application by the liquidator and the land proprietors. The purchasers appealed. The Court of Appeal dismissed the appeal in early 2023. The Federal Court, in the 3rd quarter of 2023, disallowed the leave application by the purchasers.

JMB's carparks claim dismissed

In a stratafied development in KL, JMB challenged the liquidators' decision to sell car parking bays belonging to a company in liquidation in 2017 alleging that the car parking bays were part of the common properties. High Court in April 2019 decided in favour of JMB. In Jan 2022, the Court of Appeal overturned the High Court's decision. JMB then applied for leave to appeal but the Federal Court dismissed the leave application by JMB in Nov 2022.

Rejection of POD

A listed company filed a claim against company liquidation for monies paid/advance to a subsidiary company where subsidiary company claimed to have paid on behalf of a company liquidation. Liquidators rejected the listed company's claim on 11.11.2022. Listed company then filed an appeal against the rejection by the liquidators on 01.12.2022. After filing all legal submission, the listed company withdrawn its appeal with a cost of RM10,000.00
